Cities across California have in recent years enacted or are in the process of enacting a ban on the use of natural gas in (most) new development projects. The 9th Circuit Federal Court of Appeals recently overturned the City of Berkeley’s natural gas ban, potentially calling into question the legality of similar laws in other cities and setting up the need for a clearer determination on a national level.
